Ως αποτέλεσμα είχε να χάσει τα δικαιώματα για την κυκλοφορία του παιχνιδιού. Η Ubisoft όμως πήρε τα δικαιώματα και ετοιμάζει το The Avengers: Battle For Earth! Θα βασίζεται στο Secret Invasion και θα έχει και άλλους χαρακτήρες πέραν αυτών των ταινιών! Θα κυκλοφορήσει για Xbox 360 (και Kinect) και Wii U (τον διάδοχο του Wii). Γιατί όχι PS3; Εντάξει PC , αλλά γιατί όχι στην κονσόλα της Sony;;;;;;;;;;;;;;;;; Ελπίζω να αλλάξει αυτό.
